Terms & Conditions 

1.1 General Provisions 

These Terms & Conditions (the “Terms”) govern the use of the website BERHASM.COM (the “Website”) and the purchase of goods offered on it. The Website is owned and operated by Individual Entrepreneur Besiki Turazashvili, Identification Number: 01601149565 (the “Company,” “we,” “us,” or “Seller”). 

By accessing the Website or placing an order, the user (the “Customer”) agrees to be bound by these Terms. If the Customer does not agree to these Terms, they should not use the Website. 

We reserve the right to amend these Terms at any time. The updated version will be published on the Website with the date of the last update. Continued use of the Website after changes are made constitutes acceptance of the updated Terms. 

1.2 Products 

The Website offers clothing and accessories (the “Products”) for sale. 

We make reasonable efforts to display Product images, colors, and descriptions as accurately as possible. However, slight variations between the Product images and the actual Product (e.g., due to screen settings or lighting) may occur and do not constitute a defect. 

All Products are subject to availability. We reserve the right to limit quantities, discontinue any Product, or correct pricing/description errors at any time without prior notice. 

1.3 Orders 

By placing an order on the Website, the Customer makes an offer to purchase the selected Products, which is accepted by the Seller upon order confirmation. 

The Seller reserves the right to refuse or cancel any order, including in cases of suspected fraud, pricing errors, unavailability of stock, or other valid reasons. In such cases, the Customer will be notified, and any payment made will be refunded. 

The Customer is responsible for providing accurate and complete order and delivery information. The Seller is not liable for delays or non-delivery resulting from inaccurate information provided by the Customer. 

1.4 Prices and Payment 

All prices on the Website are displayed in EUR and include applicable taxes unless stated otherwise. 

Payment is processed through the third-party payment provider UNIPAY. The Seller does not store full payment card details. 

Orders are processed only after successful payment confirmation. 

We reserve the right to change prices on the Website at any time; however, changes will not affect orders already confirmed. 

1.5 Delivery 

Delivery of Products is carried out in accordance with the Website’s Delivery Terms (Section 1), which form an integral part of these Terms. 

Delivery is carried out on a DDP (Delivered Duty Paid) basis via the shipping company 4PX, with delivery times starting from 10 business days, depending on the destination region. 

1.6 Returns and Exchanges 

The Customer has the right to return or exchange a Product within 14 days of receiving the order, provided that: 

• The Product has not been used, worn (other than to try on), or damaged 

• The Product is in its original condition, with original packaging, tags, and labels intact 

• The Customer provides proof of purchase (order number or receipt) 

To initiate a return or exchange, the Customer must contact support@berhasm.com within the 14-day period. 

Return shipping costs, unless the return is due to a defect or error by the Seller, are borne by the Customer. 

Refunds will be issued to the original payment method within a reasonable time after the returned Product has been received and inspected. 

The following items may be excluded from return/exchange for hygiene reasons, where applicable: underwear, swimwear, and similar items, unless defective. 

This section does not affect any statutory consumer rights the Customer may have under applicable law. 

1.7 Defective or Incorrect Products 

If the Customer receives a defective, damaged, or incorrect Product, they should contact support@berhasm.com within 14 days of delivery, providing photos and a description of the issue. 

In such cases, the Seller will offer a replacement, repair, or full refund, including any applicable return shipping costs, at no additional charge to the Customer. 

1.8 Intellectual Property 

All content on the Website, including text, images, logos, graphics, and design, is the property of the Seller or its licensors and is protected by applicable intellectual property laws. 

The Customer may not reproduce, distribute, modify, or otherwise use any content from the Website without prior written consent, except for personal, non-commercial use. 

1.9 Limitation of Liability 

To the maximum extent permitted by applicable law, the Seller shall not be liable for any indirect, incidental, or consequential damages arising from the use of the Website or the purchase of Products. 

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law. 

1.10 Force Majeure 

The Seller shall not be held liable for any failure or delay in performance caused by circumstances beyond its reasonable control, including but not limited to natural disasters, customs delays, carrier disruptions, strikes, or governmental actions. 

1.11 Privacy 

The processing of the Customer’s personal data is governed by the Website’s Privacy Policy (Section 2), which forms an integral part of these Terms. 

1.12 Governing Law and Dispute Resolution 

These Terms shall be governed by and construed in accordance with the laws of Georgia, without regard to conflict of law principles. 

Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of Georgia, unless otherwise required by mandatory consumer protection laws applicable to the Customer’s place of residence. 

The parties will first attempt to resolve any dispute amicably through good-faith negotiations before pursuing formal legal proceedings.
